Health insurance reform and consumer protection rule released

Interim final rules have been issued under the Patient Protection and Affordable Care Act (PPACA) implementing new health insurance reforms and consumer protections.

Interim final rules have been issued under the Patient Protection and Affordable Care Act (PPACA) implementing new health insurance reforms and consumer protections. Specifically, the regulations prohibit arbitrary rescissions of health coverage; ban lifetime limits on coverage; restrict annual dollar limits on coverage; protect a patient/resident choice of provider; and remove existing barriers to emergency care. The rules are generally applicable for health plan/insurance policy years beginning on or after Sept. 23, 2010. With regard to preexisting condition exclusions for individuals age 19 and over, the regulation is applicable for plan/policy years beginning on or after January 1, 2010.

HHS has a Fact Sheet available for more information. AHCA/NCAL’s Legislative Counsel, Greenberg Traurig has prepared a summary of the rules.
